By accessing or using the FinTech Studios platform, website, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Account Terms

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify FinTech Studios immediately upon becoming aware of any unauthorized use of your account.

You must be at least 18 years of age to use the Services. By creating an account, you represent that you meet this age requirement.

3. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Services or any systems or networks connected to the Services

  • Scrape, data-mine, or otherwise extract data from the Services in a manner not permitted by your subscription plan
  • Resell, redistribute, or sublicense the Services or any content obtained through the Services without prior written consent
  • Interfere with or disrupt the integrity or performance of the Services
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity

4. Intellectual Property

The Services, including all software, content, designs, trademarks, and other materials, are the proprietary property of FinTech Studios, Inc. and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

Content generated by the Services using artificial intelligence is provided for informational purposes. You retain ownership of any original content you input into the Services. FinTech Studios retains all rights to the underlying AI models, algorithms, and platform technology.

5. Subscription and Payments

Certain features of the Services require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected. All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms.

FinTech Studios reserves the right to modify pricing with 30 days' prior notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.

6. Termination

Either party may terminate these Terms at any time. FinTech Studios may suspend or terminate your access to the Services immediately, without prior notice, if you breach these Terms or if required by law. Upon termination, your right to use the Services will cease immediately. You may request export of your data within 30 days of termination.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FINTECH STUDIOS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR FINANCIAL, LEGAL, OR INVESTMENT DECISIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FINTECH STUDIOS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. FINTECH STUDIOS' TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in New York County, New York.

10. Changes to Terms

FinTech Studios reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
